1. Acceptance of Terms

By accessing or using the Dishly service, website, or any applications made available by Dishly (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Dishly provides a restaurant ordering system that allows restaurant owners to create digital menus accessible via QR codes and enables customers to place orders directly from their devices.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Service Tiers and Limitations

Dishly offers different service tiers with varying features and limitations:

  • Free Tier: Limited to 16 tables and 64 menu items.
  • Unlimited Tier: Provides unlimited tables and menu items, along with additional features.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.

5. User Content

You retain all rights to the content you upload, post, or display on or through the Service ("User Content"). By submitting User Content, you grant Dishly a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such User Content for the purpose of providing and improving the Service.

You represent and warrant that you own or have the necessary rights to the User Content and that the User Content does not violate the rights of any third party.

6. Prohibited Conduct

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Interfere with or disrupt the Service or servers or networks connected to the Service
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service to transmit any viruses, worms, or other malicious code
  • Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity

7. Termination

We may terminate or suspend your account and access to the Service at any time, without prior notice or liability, for any reason, including if you breach these Terms.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9. Limitation of Liability

IN NO EVENT SHALL DISHLY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.

10. Changes to Terms

We may modify these Terms at any time. If we make changes, we will provide notice by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Dishly is established, without regard to its conflict of law provisions.
